Sir,
With reference to your letter to the Colonial Office
(S 36779) of the 31st October, 1932, regarding the
Hong Kong piracy case of Rex versus Chung Tam Kwong and
others, I am directed by the Board of Trade to state
that, as the questions involved concern not Hong Kong
only but wider imperial interests, they consider it
important that the case should be referred to the
Judicial Committee of the Privy Council, as recommended
by the Law Officers.
The Board earnestly hope therefore that no question
of the apportionment of the cost, as between
His Majesty's Government in the United Kingdom and the
Hong Kong Government, will be allowed to stand in the
way of the necessary reference being made at the
earliest possible date.
